Our Terms and Conditions

Money Back Guarantee
We are confident in what we deliver and hope you enjoy your time with us!  You know what suits you best though, so as per the home page on our website, if you decide after your first lesson that you no longer wish to continue your lessons with SWiM-LTD, we will return 100% of your lesson charge to you.

Teachers/Classes
SWiM-LTD cannot guarantee the same teacher for every session, but will try our best to keep consistency.  All our teachers are ASA or STA qualified teachers, lifeguard trained, have enhanced DBS disclosures and are fully insured.  All SWiM-LTD teachers are also fully trained in delivering the 'SWiM-LTD' scheme.  Refusal to accept a lesson from a replacement teacher will result in that lesson being forfeited.  SWiM-LTD may also where required change a class time, but we also try our best to keep any changes to a minimum.  Refusal to accept a new class time will result in lessons being forfeited.

Progression
The initial day and time of any swimmer's session is subject to change during their time with SWiM-LTD, as the swimmer progresses through the scheme.  Teacher updates on a swimmer's SWiMPortal will trigger class move emails where appropriate.

Lesson Fees
Lesson fees are subject to review on the 1st April each year.  Our payment gateway provider is GoCardless and payments are processed via Direct Debit.  Read more here.

All payment info must be set-up prior to a swimmer's first lesson with us.  Swimmers will not be allowed to participate in any swimming lesson until payment info is set-up: an initial payment will include the final month's fee and so whenever notice is given, no further payment will be collected.

Re-enrollment
Re-enrollment for the next month of lessons is done automatically.  It is the customer's responsibility to update any changes to your payment info and maintain your lesson charges that fall due on the 1st of each month.  In the event your payment cannot be processed, it will be re-tried three times and reminders will be sent via push notification (if you have the iClassPro Mobile App installed) and/or text to the mobile number supplied to us by you.  If a lesson charge is outstanding you will receive our 'Lessons Paused' message and will be unable to access lessons until your payment has been successfully processed.  After three failed processing attempts, a £5 administration charge may be added to your balance.

Recommend A Friend
The feedback we receive from our customers is extremely valuable to us and many new swimmers arrive with us via word of mouth.  If you hear about us via a friend of yours, let us know!  At the point of a new swimmer enrolling into a class, a £5 credit will be applied to the account of the customer who recommended us.

Non-Attendance/Cancelled Lessons
In accordance with our *'Money Back Guarantee', if you decide after your first lesson that you no longer wish to continue your lessons with SWiM-LTD, we will return 100% of your lesson charges to you, including that for the lesson attended.

Any lessons not attended by a swimmer are forfeited, whether due to illness, holidays or COVID related absence.  On occasion, it may be possible for the lesson to be taken in an alternative slot, where availability allows.  Where a request for an alternative slot is made by you as the customer, SWiM-LTD will provide you with the times and days of any available slots in equivalent classes.  In the event that no alternative slots are either available or taken up, the lesson remains forfeited.
 
If a lesson is cancelled for unforeseen reasons by SWiM-LTD, a message will be sent at our earliest opportunity to both the email address(es) and via push notification (when possible) to the mobile phone number supplied to us by you - the iClassPro Mobile App needs to be installed on a device for push notifications to be received.  The message will also be available to view within the iClassPro Mobile App.  It is the customer's responsibility to keep SWiM-LTD updated of any changes to the contact details submitted to us on your initial booking.  Any changes can be made directly in your account via the iClassPro Mobile App.  A make-up token will be added to all affected accounts, and will allow swimmers from cancelled classes to attend an alternative session, where available. 

If a swimmer wishes to pause their place due to an upcoming planned absence (such as for an operation or planned extended break, lasting three weeks or more), SWiM-LTD may hold a swimmer's place from week three onwards, at 50% of the current lesson charge.  

Notice
If a swimmer wishes to cancel lessons, we simply require a 30 day written notice.  Once this has been received, we will issue confirmation of the swimmer's final lesson date and the final charge to be taken immediately, to cover any lessons outside of the usual monthly charge (e.g. if notice is given on the 15th of May, lessons can be attended until the 14th June, with a final charge taken immediately to cover lessons from 1st - 14th June.  The usual lesson charge will be cancelled at this point).  Any makeup tokens used to cover a notice period can only be done so up to the value of the notice period (makeup tokens unused above this are forfeited).

Holidays
Any lessons not attended by a swimmer due to a holiday absence are forfeited.  On occasion, it may be possible for the lesson to be taken in an alternative slot, where availability allows.  Where a request for an alternative slot is made by you as the customer, SWiM-LTD will provide you with the times and days of any available slots in equivalent classes.  In the event that no alternative slots are either available or taken up, the lesson remains forfeited.

Swimmers will be notified via the iClassPro Mobile App of any planned holiday closures of the office and lessons, such as at Summer and Christmas.

If a swimmer wishes to pause their place due to an upcoming planned holiday (lasting three weeks or more), SWiM-LTD may hold a swimmer's place from week three onwards, at 50% of the current lesson charge.  

Medical, Behavioural Conditions and Individual Needs
It is really important to us that we provide the best lesson for each swimmer with us.  SWiM-LTD cannot accept responsibility for the medical or behavioural condition or other needs of any swimmer unless a full disclosure of the details has been made through your initial booking prior to commencement of lessons or following any medical or behavioural condition being confirmed during your time with us.  It is the customer's responsibility to keep SWiM-LTD updated of any changes to the details submitted to us on your initial booking.

Supervision
Swimmers, parents, guardians, siblings and all other associates must observe the venue's entry rules and respect all other venue rules whilst on site.  Facility staff shall retain the right to refuse admission.  It is imperative that swimmers are on poolside NO MORE than 5 minutes before the commencement of each lesson and must be collected promptly after the lesson has ended.  Children MUST NOT be left unsupervised on poolside prior to the start of their class and a responsible adult must remain within the venue during the whole of the lesson.

Behaviour
In the event of a swimmer, parent, guardian, sibling or other associate refusing to obey an instruction from SWiM-LTD teacher or member of venue staff, behaving in an unruly manner towards a SWiM-LTD teacher or member of venue staff or any other person, or causing damage to pool premises or equipment in those premises, the swimmer shall not be permitted to continue with the lessons.  SWiM-LTD shall then reserve the right to terminate the lessons without further notice and without being required to offer any credit or refund to the swimmer and the swimmer shall not be accepted for any future courses.

Venue staff reserve the right to enforce their own centre rules with regard to behaviour.  Any swimmer, parent, guardian, sibling or other associate behaving in a manner that the centre feel inappropriate or detrimental to other members will be informed as such and may be therefore asked to leave the premises.  Any such behaviour may result in SWiM-LTD reserving the right to terminate the lessons without further notice and without being required to offer any credit or refund to the swimmer and the swimmer shall not be accepted for any future courses.

Valuables
SWiM-LTD cannot accept liability for the loss of, or damage to, any personal effects brought to any session and you are therefore requested to ensure that no valuable items are brought to swimming lessons.

Conditions of Pool Premises
Whilst SWiM-LTD will make all reasonable efforts to ensure that the condition of the pool premises, including the changing rooms, washing facilities, the pool and poolside area are in suitable condition, they do not accept liability for any injury to a swimmer which may be caused by any defect and further advise that any claim arising from such a defect must be addressed to the proprietors of the pool premises.

Transmission of Infections
Any swimmer known to be or found to be suffering from any infectious ailment or condition will not be allowed to participate in the lesson and it is the responsibility of each swimmer or (in the case of a child swimmer) the parent or guardian of the swimmer to ensure that the swimmer is fit and well enough to participate.  SWiM-LTD will not accept liability for any infection passed to a swimmer by another swimmer on the course or in the pool.
